These Terms govern the sale by Stakelum Store to you of Products for which you place an order that is accepted by us.
General
Stakelum Store shall not be liable to you for any loss or damage which you might suffer arising from Stakelum Store delay in fulfilling or failure to fulfil any of its obligations under these Terms to the extent that such delay or failure is caused by any circumstance beyond Stakelum Stores reasonable control.
If due to such circumstances or events Stakelum Store has insufficient stocks to meet all its orders, Stakelum Store may apportion available stocks between its customers at its sole discretion. These Terms and any terms appearing on any order form to which these Terms apply constitute the entire agreement between you and Stakelum Store relating to the Products.
The failure of Stakelum Store or you to enforce any of these Terms does not constitute a waiver of that term and shall in no way affect the right later to enforce the term. The invalidity or unenforceability of any clause of these Terms shall not adversely affect the validity or enforceability of the remaining provisions.
No amendment, variation or addition to these Terms shall be binding unless agreed to in writing by an authorised representative of Stakelum Store.
Stakelum Store may transfer any contract with you concluded on these Terms or any of its rights or obligations under any such contract. These Terms will be construed in accordance with the laws of The Republic of Ireland and any disputes shall be settled by the Irish courts.
Liability
Nothing in these Terms shall exclude or limit Stakelum Store liability for fraud or for death or personal injury caused by its negligence or any other liability to the extent that the same may not be excluded or limited as a matter of law. Without prejudice to the previous sentence, Stakelum Store shall not be liable for any loss of income or profits or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by the negligence of Stakelum Store, its breach or non-performance or any of its obligations under these Terms or otherwise.
These Terms set out the full extent of Stakelum Stores obligations and liabilities in respect of the sale of the Products. In particular there are no conditions, warranties or other terms, expressed or implied, as to satisfactory quality, fitness for a particular purpose or of any other kind whatsoever, that are binding on Stakelum Store except as specifically stated in these Terms.
Any condition, warranty or other term concerning the sale of the Products, which might otherwise be implied into or incorporated within these Terms, whether by statute, common law or otherwise, is excluded to the fullest extent permitted by law. If you are a consumer the exclusion of terms implied by law will not apply to you.
Warranty
All products purchased through Stakelum Store benefit from the manufacturers warranty or guarantee, if any. Legally, this clause only applies to business customers. Please note that the use of an electric screwdriver for the assembly of chairs will void your guarantee.
Returns
We will happily refund or exchange any item purchased from www.stakelumstore.com
We reserve the right to charge a returns handling fee.
All goods must be unused, in a saleable condition, and in their original packaging.
Please notify us within 14 days should you wish to return any item(s) we have supplied. We will pay the return shipping costs if the product is defective or the return is a result of our error. If the item is returned for any other reason you are responsible for the return shipping amount.
Furniture Delivery
Please be aware that all furniture comes assembled for customers. Our expert team can assemble on-site or deliver fully assembled. A member of the sales team will be in contact to organise delivery with you within 48 hours of your purchase. There is no extra charge for assembly however delivery of furniture takes 7- 9 working days.
Backorders
Any item that is out of stock when ordered will be placed on backorder; you will be notified by e-mail of the expected delivery date.
Should we receive no response from our e-mail we will assume that you wish to accept the goods on the date as specified.
If the delivery date is unacceptable please respond to our e-mail and we will cancel the backorder and either credit your credit card or, if you are an account customer, you will not be invoiced.
